 Pubblicato in GURI n. 41 - Supplemento Ordinario n.36 del 19 febbraio 2010Â il Decreto Legislativo 27 gennaio 2010, n. 17 di recepimento della nuova direttiva macchine 2006/42/CE. Il provvedimento entra in vigore il 06 marzo 2010. Di seguito si riportano le sanzioni di cui all'art.15 del decreto:
1. Salvo che il fatto non costituisce reato, il fabbricante o il suo mandatario che immette sul mercato ovvero mette in servizio macchine non conformi ai requisiti di cui all'allegato I del presente decreto è punito con la sanzione amministrativa pecuniaria da 4.000 euro a 24.000 euro. Alla stessa sanzione è assoggettato chiunque apporta modifiche ad apparecchiature dotate della prescritta marcatura CE, che comportano la non conformità ai medesimi requisiti.
2. Salvo che il fatto non costituisce reato, il fabbricante di una quasi-macchina o il suo mandatario che contravviene alle prescrizioni di cui all'articolo 10 del presente decreto è punito con la sanzione amministrativa pecuniaria da 3.000 euro a 18.000 euro.
3. Ferma restando l’applicazione dei commi 1 e 2, il fabbricante o il suo mandatario che a richiesta dell’autorità di sorveglianza di cui all’articolo 6, omette di esibire la documentazione di cui all’allegato VII del presente decreto è punito con la sanzione amministrativa pecuniaria da 2.000 euro a 12.000 euro.

 Pubblicata su GUCE serie C71 del 19 marzo 2010 la comunicazione della Commissione nel quadro dell'attuazione della direttiva 2006/95/CE del Parlamento europeo e del Consiglio, del 12Â dicembre 2006, concernente il ravvicinamento delle legislazioni degli Stati membri relative al materiale elettrico destinato ad essere adoperato entro taluni limiti di tensione.
Con tale comunicazione viene aggiornato l'elenco degli standard che garantiscono presunzione di conformità alla direttiva bassa tensione.

The new directive only 2 types of declaration (Annex II):
*IIA - the EC declaration of conformity to the Directive and other directives which may fall out from the car manufacturer;
* IIB - Â Â Â IIB - the declaration of incorporation for most - cars. This statement must contain the precise list of RES fulfilled (significant)
Both statements contain another very important news: the clear indication of the person authorized to compile the relevant technical
documentation or the Technical Construction File ... (name and address in the EU)

 The New Machinery Directive 2006/42/EU issued on May 17, 2006 by the European Parliament and council repeals 98/37/EU, yet State Members have adopted the prescripted, legislative and administrative dispositions in order to  to comply with the directive on June 29, 2008, while the application of the above - mentioned dispositions will be effective from  December 29, 2009.
The area of applicability of the new directive clarifies a number of issues that have been misinterpreted over time (ie. as the new concept of PCM, "partly-completed-machinery") and explain other features (ie. as the introduction of "lifting accessories", "chains, ropes and webbing").
Specification of electrical and electronic products falling within the following areas, insofar as they are covered by Council Directive 73/23/EEC of 19 February 1973 on the harmonisation of the laws of Member States relating to electrical equipment designed for use within certain voltage limits.
- household appliances intended for domestic use,
- audio and video equipments,
- information technology equipments,
- ordinary office machinery,
- circuit breakers and switches.
- electric motors
Electric and high tension equipments to whom the New Machinery directive do not apply
- switch gears and control gears,
- transformers
Subsets of machinery are already contained in the current Directive. The producer is bound to enclose a proper declaration.Â
Nonetheless, the notion of subset has often been misinterpreted: in a broader sense (a machinery considered as a subset as it works autonomously) or in a more restrictive way ( a simple component considered as a subset) (see DPR 459/96 Annex II) with forbiddance of con divieti di messa in servizio talvolta sbagliati.
Definition of PCM, "partly-completed-machinery": set that is almost a machinery and yet is not up to guarantee a well determined application.
A driving gear is a partly-completed-machinery.

 The new Machinery Directive provides an internal control on fabrication  for the machinery not mentioned in Annnex IV:
in the new Annex VII ther's guidance on how to build a "technical construction file" with its own annexes, apart from
the "relevant technical documentation" which is the partly machines' techical file
For the machinery (and the security components as well) that fall within Annex IV two cases are distinguished
